Osama bin Laden's driver has just been convicted of providing material support to terrorists following an illegal, secretive terrifying kangaroo court trial at Guantanamo. Joining Rachel tonight to talk about Hamdan's life, trial and conviction is the man who just wrote the definitive book on the subject, Jonathan Mahler. His new book is called: The Challenge: Hamdan v. Rumsfeld and the Fight Over Presidential Power.

Also, journalists only need the vaguest sign of friendship between one of the candidates and another politician to assume that a vice presidential choice is nigh. But, it does seem like Obama is spending an awful lot of time with Evan Bayh. So much so that we are nervous this is more than a coincidence. So we've asked John Nichols to join us today to talk about why Bayh would be a terrible, terrible running mate.

Great to hear Gil Scott-Heron on the show two days running. Would be nice to hear "I Think I'll Call It Morning" for those days when Ms. C. Little needs cheering up or "When You Are Who You Are" on the days when Sen. Obama doesn't let Rove-McCain define him.

By the way, I read late 2007 that GSH was starting to perform shows again and might be recording some new music. Anybody in NYC heard any more details about concerts or new music?

As far as the polling information, would you be able to have a guest on the show who can reassure us that there is a significant Obama undercount happening? I know that I read earlirer in the primaries that the polling folks don't call mobile phone users in their surveys (too costly). Since many younger voters use those phones rather than land lines, they are under represented, enough so that a 3% lead may truly be 5 to 7%. Would Zogby address that situation? Is this something that Chuck Todd ever mentions in private MSNBC sessions?

Race For The Whitehouse and Battleground States

Rachel,

I was following the show regarding which states are battlegrounds and polls and I was following along looking at www.pollster.com which shows a composite polling chart for each state. During the show I was left with the distinct impression that RFTWH is trying to make this race appear closer than it actually is presumably with the intention of driving ratings.

North Carolina has 15 electoral votes and is less than 3 points apart, yet it wasn't even mentioned in the list of states. Obama is leading in Montana. Florida is within the margin of error with its 27 electoral votes and they chalked it up for McCain.

Something is rotten in Denmark... and your lack of comment makes you complicit!

Media manipulation toward misinformation...

One of the main ways elections are stolen is how mainstream media seemingly fails (almost deliberately) to report critically important stories and information. If only Radio Air America reports a viewpoint, story, or information that rightwing media chooses to ignore, the US public thus is misinformed and cannot cast an informed vote. Not everybody listens to RAA.

The Tennessee masacre is an important story. Jim Adkisson went bezerk because right wing media personalities led him to believe Unitarian Universalists were godless America-haters and worse. The mainstream media has unsurprisingly decided this story needs to quietly go away.

I also hold her to a higher standard because I feel she is on our side. The side of reason, responsibility, and truth.

Frankly I find it amazing which stories go away and which ones stick around. Lacey Peterson... why do I even know that name? Yet the Downing Street Memo hardly ever gets talked about. There are key people who have the ability to advance the conversation along the correct lines. These are the people whom we should apply pressure.

The question about the media that haunts me is this: Does the media deliberately try to influence politics (Fox is a given)? I am sure they chase ratings... but do they deliberately misreport news in favor of ratings? How do these mechanisms work and what can we do to stop them.

I browsed around and didn't see any *general* comment section, so I hope this is an appropriate venue for my suggestion. Rachel, can you get Bruce Fein on your show? I'm absolutely mesmerized by this man. He's been, as I'm sure you know, testifying on Impeachment for the House and is uncommonly eloquent. His unbiased credentials on this subject are pretty unassailable, as he's applied his views on both sides of the aisle over the years, which makes him extra interesting. I've seen him on C-span and the MSM, and I sense this guy needs a medium on which to let loose. The House hearings and interviews I've seen thus far always end in him holding his tongue on this that or the other. I'd love to hear the whole ugly truth. Where better than the RMS? :) Anyway... just a suggestion!

Allison, good point BUT

Bruce Fein has been a huge proponent of Impeachment and for that I have been hugely thankful but he is also usually FAR right in all of his politics. Yes, sometimes even Republican's can't help but be incensed by how Bush/Cheney have discarded our Constitution!

As far as his credentials go, I guess that would depend on what grounds you are judging . His attacks on Clinton during his impeachment were non stop and the glee he seemed to find in doing so was always clearly evident.

Let him help in getting the "current criminals in office" OUT of office, but all in all I am still not sold on the guy.

I hear ya!

Normally I see Reagan-credentials-anything and I head for the hills. But I'm a little more tolerant if the person's cause seems genuinely nonpartisan. That, to me, is indicative of a consistent truth, value or conviction underneath, which makes me better able to hear what the person has to say. Moreover, he really is lovely to listen to on the subject. It's the type of eloquence that comes with a healthy mixture of intellect and passion.

I thought the Clinton Impeachment was as silly as silly could get - huge shocker for a poster on Air America, I know. :) But I guess one could argue that that *was* true until Clinton committed actual perjury, which is when the academic set like Fein seemed to really get in a twist.

In any event, part of the point he's been making to anyone who will listen is that Impeachment has a somewhat puffed-up importance in light of the fact that it's the only legal recourse against certain elected officials in the event of any manner of serious crimes - *or* mere misdemeanors. The cultural march toward imperial presidencies over the years is exactly the type of mind-frame that has led to Impeachment gaining this false patina of gravity, when it should be considered as no more or less unusual as any other process of government. And if one views it in that light, Clintonesque perjury is as much under its aegis as the suspected High War Crimes of the current administration. At least, that's what I think constitutional scholars like Fein would argue. :)

But either way, I feel fairly certain he and Rachel would have a very illuminating and engaging conversation. I'd love to hear it. ;)

Bruce Fein has been a credible, strong, and persistent voice sounding the alarm for the last few years about the big issues surrounding the "unitary executive," separation of powers, rule of law, and abuses of power such as signing statements. I would definitely like to hear Maddow interview him. Thanks for suggesting it.

Bayh Campaigning

I was talking to a friend from NW Indiana who seems pretty tuned into Indiana politics and he told me that Bayh will not be on the ticket but he will play a major part in the campaign in Indiana, Kentucky, and Southern Ohio specifically. While the Obama camp is not expecting to win in Ky and probably not in Indiana either, they think that Bayh will help in those states and the idea is to have McCain use resources in those two states, rather than coast.

Nice to hear your guest give props to Birch Bayh. Bayh was also part of the big ERA push and a key pointman for Title IX legislation. I did volunteer work for his short-lived presidential campaign in '76. Too bad he wasn't able to do better in Iowa that year. I haven't heard much in the media about him lately - would make an interesting guest. Just wish that his son would be more like him.

I wish i was a fan of whiskey, im afraid all i can handle is southern comfort...im not much of a liquor buff, i prefer herbal remedies, which brings me to my next, completely off-topic question: Rachel, what is your stance on the medicinal/recreational use of marijuana and / or possible legalization of such?

If you want to talk about herbal remedies....

..... we can talk for HOURS.

But first things first. I am not well versed in the medical marijuana world. But recently I was talking to my gardener, and I was telling him about making tinctures from herbs (VERY easy to do), and he told me that in Mexico a common folk remedy is to put pot leaves in alcohol and let it sit. Just like you would a tincture. Then people use it to rub on sore muscles. I found that FASCINATING!!! AN actual folk remedy based on pot!

Having said that, I am an advocate for the medicinal uses of plants. I hate this whole illegality of plants. The plants did nothing wrong, but since people are misusing them.... Hmmm... come to think about it, that is the same argument of the gun lobby... LOL.

Anyway, I believe that there always is an alternative for any plant. I have no scientific research to back this up, but I believe that all habitats provide the cures needed for all diseases (OK, maybe the Amazon is likely to have more healing plants than the desert.... but please don't let that minor fact detract from my flawless logic). Therefore, I would encourage you to look for natural alternatives in your region and advocate for native plants, rather than sticking to one plant or the other.

One book I use is Indian Herbalogy of North America, among others (yes, it's Herbalogy.... I am not making a typo Mr. Crusty). I even used this book to help me select the Native California plants I planted in the backyard.

Then, look for what you are after. For example, got nausea? Try ginger. Got pain? Try California poppy (just be careful. Like all poppies, its properties are opiates and if you need to get a drug test you will test positive. Not unlike eating a poppyseed muffin... which by the way, it's a great thing to do if you are stressed. Having a bad day? Go to the local coffee shop and gobble up a poppy seed muffin!). Got glaucoma? Try gumweed.

This is where alcohol comes in very handy.... HIC!

If you have an herb you like, most likely you can make a tincture out of it. Simply place the herb in a jar, and add vodka. I've read people say that the strongest the vodka the better, and other don't really care. So I figured that way back in the day these things were not as scientific, so I try to fill the jar with as much of the herb as possible. Then I just pour vodka over it and let it sit for a couple of weeks (shake twice a day). This is for fresh leaves...

If you are using dry leaves -- say medicinal marijuana for your sore muscles -- use less. That is, about half a jar of herb to a jar-full of vodka. Never tried it... so if you do let me know how it works for you.

Maybe this was more than you were bargaining for. So sorry if I overwhelmed you with info. :)

It seems possible that AAR blocked this person's access under his old login. If they did, I applaud them, and I'd support banning the person by IP address. However, I can recognize that if this person is really determined to get back in, he'll likely find a way to regain access.

So, I think we have to do our part, and I think the very best thing we can do is to totally -- no exceptions, always, no matter what, forever -- ignore this individual.

I don't want to lecture anybody for having replied to this individual. I have, myself, replied a few times against my better judgment, until I got a really good read on the level of viciousness behind these posts. So, I absolutely understand how hard it is to remain silent while the blog is being constantly bombarded with inflammatory insults, racist and homophobic remarks, and other generally infuriating and destructive behaviour. It's been especially hard when some of the most disturbing comments have been personalized -- aimed at specific bloggers.

By encouraging use of the perma-iggy option, I realize I'm not telling any of you anything that you didn't already know. A lot of us have reminded each other now and then to stop engaging this person, and if we need to do so again, let's do it. But I'd like to try to go one step further. I think our best hope is to band together and ignore this person. It's the best way I can think of to -- individually and collectively -- declare that this is not worth our time.

So, I am hereby pledging to all of you: I will not reply to this person again. If I have a moment of weakness and reply to this person, I'll give $350.00 to a charity chosen by the first person to call me on it on the blog.

I'm kind of upset that you're still feeble and ailing, and I've been trying to think of something to do to make you feel better. I like it when you're curmudgeonly and irascible and all piratey.

So here's all I can think of. I fenced in college and, somewhere around here, I have the old foil I used to run my opponents off the mat screaming in Carmichael Auditorium. I'm not sure a foil, especially one with the regulation plastic tip on the end, is particularly pirate-ish. You really deserve a sabre. But I am willing to send it anyway. It is kind of empowering just to walk around with it. The only reason I've kept it around is that I loved fencing, and holding that foil still makes me feel like a bad-ass.

About IP address....

But you mentioned IP addressed in your post. My understanding is that the IP address is related to the network you log into the Web through. Say, I log in from work, then my work's network would be tracked. If I log in from home, then my home network (say AT&T) would be tracked. So what happens if I were to take my laptop to a coffee shop? How does IP tracking work in that kind of scenario?

Non-network-administrator minds would like to know.

whiskey

A while ago, Rachel gave out the recipe for the Sazerac. I spent the better part of the year trying to find a decent one. Three states, countless bars. Most bartenders had never heard of it. But even at the places that had it on their menus, it was terrible! It just tasted like an angry glass of whiskey.

Just when I was ready to give up, Todd at Rialto in Harvard Square (Cambridge, MA) set me straight. When made correctly it really is a great cocktail.

Now the real trick is finding a store that'll sell me Peychaud's bitters. (I know, I know, I could just order it online. But where's the sport in that?)

Well-made sazeracs are hard to find. I've had good ones in New Orleans and in San Francisco (the Slanted Door). Here in Austin, Texas, finding the proper biters is not tough, fortunately. Absinthe, while available, is pricey.

Late to the whiskey

I was a couple of days behind on the podcast, so I've only heard Rachel's cheap whiskey list just now. Yay!

Per her suggestion, here are a couple of my favorites, with the upper end of "cheap" being around $20.

I concur with Rachel on the Wild Turkey 101 and WT rye. Based on her recommendation some time ago, I picked up Jim Beam rye, which I liked. I promptly turned a second bottle into homemade bitters. Jim Beam bourbon on the other hand is vile stuff, IMHO.

We love Rachel, and Rachel's cocktails!

Based on previous recommendations, we now stock Applejack at home, to use in Pink Ladies. I will try some of these whiskey selections asap.

Gin and NOT Vodka? OMG!

Rachel,

I have been a born and bred Vodka martini drinker and always hated even the idea of gin (stories to grisly to print), yet because of your insistence, I "TRIED" a gin martini for dinner the other night just to see.

Well, even though I felt as if I was drinking perfume, I kind of got into it after awhile. The scent was a bit overwhelming, but the flavor wasn't terrible and I actually think I will try it again. So thank you for putting this into my head...I guess I might even enjoy them after a few more "Practice" sessions!
